These Terms of Service ("Terms") govern your use of the paramelukn website located at paramelukn.top and our beauty salon analytics platform services operated by paramelukn Ltd, a company registered in Malta under company number C96587 with its registered office at Triq it-Torri 32, Valletta VLT 0327, Malta.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the service. These Terms constitute a legally binding agreement between you and paramelukn.

Description of Service

paramelukn provides a comprehensive analytics platform specifically designed for beauty salons and spa businesses. Our services include:

• Client behaviour analysis and tracking
• Revenue optimisation insights
• Staff performance analytics
• Business intelligence reporting
• Data integration with existing salon management systems
• Compliance and data protection services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to our clients.

User Accounts and Registration

To access certain features of our platform, you may be required to create an account. When creating an account, you must provide accurate, complete, and current information. You are responsible for:

• All activities that occur under your account
• Immediately notifying us of any unauthorised use of your account

Payment Terms

Our platform is offered on a subscription basis with various pricing tiers. Payment terms include:

• All fees are quoted in Euros (EUR) unless otherwise specified
• Subscription fees are billed in advance on a monthly or annual basis
• All payments are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days' notice
• Failure to pay fees may result in suspension or termination of services

Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of paramelukn and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any data you input into our platform. However, you grant us a limited licence to use, process, and analyse this data solely for the purpose of providing our services to you.

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access to our platform. We may experience downtime for:

• Scheduled maintenance and updates
• Emergency repairs or security updates
• Third-party service provider issues
• Force majeure events beyond our control

We will endeavour to provide reasonable notice of planned maintenance activities.

Limitation of Liability

In no event shall paramelukn, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Our total liability to you for all claims arising out of or relating to these Terms or the use of our services shall not exceed the amount you have paid to us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless paramelukn and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees).

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion. Upon termination, your right to use the service will cease immediately.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be interpreted and governed by the laws of Malta, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts of Malta. However, we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorised to use the service.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
